Terms of Service

These Terms of Service ("Terms") govern your access to and use of the services, software, and products ("Services") provided by Swift Serve LLC ("SwiftServe," "we," "us," or "our"), a limited liability company organized under the laws of the State of Texas, United States.
By creating an account, clicking "I agree," or using the Services, you agree to be bound by these Terms. If you use the Services on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms. If you do not agree to these Terms, do not use the Services.
1. Service Description
SwiftServe is a business-to-business (B2B) restaurant technology platform that provides:
- Restaurant Websites: Custom-hosted restaurant websites with a block editor, color presets, and configurable themes
- Digital Menus: Online menu display and management
- Online Ordering: Customer-facing ordering for pickup, delivery, dine-in, and catering
- Reservations: Table reservation management (available as an add-on or included in eligible plans)
- Events and Careers: Event listings and job posting management
- Blog: Content management for restaurant news and updates
- AI-Powered Analytics: Website traffic analytics, order trend predictions, and performance dashboards
- AI-Powered SEO: Automated search engine optimization content generation
- Custom Domains: Use your own domain name for your restaurant website
- BizSync: Automatic synchronization of your Google Business Profile and other major business profiles
- POS Integration: Synchronization with point-of-sale systems such as Clover, Toast, and other supported providers
- Delivery Integration: Third-party delivery fulfillment through DoorDash and Uber Direct
- Third-Party Integrations: Connections to external services and platforms
2. Account Registration and Access
2.1 Eligibility
To use our Services, you must:
- Be at least 18 years of age
- Have the legal authority to bind your business to these Terms
- Provide accurate and complete registration information
- Be a legitimate food service or hospitality business
2.2 Account Security
You are responsible for:
- All activities that occur under your account
- Maintaining the security of your login credentials and API keys
- Configuring role-based access (Owner, Manager, Staff) with least-privilege practices
- Notifying us immediately of any unauthorized access at support@swiftserve.io
2.3 Multi-Location Access
SwiftServe supports multi-location management. You are responsible for assigning correct roles and permissions across all locations under your account.
3. Subscription Plans and Billing
3.1 Plans
SwiftServe offers the following subscription plans. Annual billing is available at a discounted rate compared to twelve monthly payments.

3.2 Add-On Modules
Additional features may be added to your plan for an extra monthly fee:
- Custom Domain: $15/month (included in Core and Ultimate)
- Online Ordering: $20/month (included in Lite and Ultimate)
- Reservations: $40/month (included in Ultimate)
- SwiftSEO: $150/month (included in Ultimate)
- BizSync (Google Business Profile and other major profile sync): $10/month
- POS Integration (Clover, Toast, and other supported POS providers): pricing as shown in your Client Portal
- Analytics Premium: $20/month (included in Core and Ultimate)
- AI Pro: $30/month (included in Ultimate)
- External Links: $10/month
- Third-Party Integrations: $30/month
Module availability and pricing may vary. Current pricing is displayed in your Client Portal.
3.3 Additional Locations
Each plan includes a set number of locations. Additional locations beyond the included count are billed at $20/month per location.
3.4 Trial
We may offer a trial period with limited features. Trial terms, including any nominal trial charge, will be communicated at the time of signup.
3.5 Payment Terms
- All fees are quoted in U.S. dollars and are exclusive of applicable taxes
- Subscription fees are billed in advance on a monthly or annual basis according to your selected plan
- You authorize us to charge your payment method on file on a recurring basis
- All fees are non-refundable except as required by applicable law
- Late or failed payments may result in service suspension
- We reserve the right to modify pricing with at least 30 days advance notice
3.6 Taxes
You are responsible for all applicable taxes (sales tax, use tax, VAT, or similar). We will collect and remit taxes where required by law.
4. Payment Processing
4.1 Subscription Payments
Subscription billing is processed through Stripe. We store only tokenized references to your payment methods. Full credit card numbers are never stored on our systems.
4.2 Customer Order Payments
Online order payments from end customers are processed through Stripe on behalf of the restaurant. Each restaurant location connects its own Stripe account through our platform.
4.3 Fees on Orders
- Delivery orders may include a customer-facing service fee and a platform application fee
- Pickup and dine-in orders do not carry additional platform service fees
- Delivery fees are determined by the delivery provider (DoorDash, Uber Direct) or by the restaurant for self-delivery
- Tipping is optional and passed through entirely to the restaurant
5. Your Content and Data
5.1 Ownership
As between you and SwiftServe, you retain ownership of all content you submit to the platform ("Your Content"), including menus, images, brand assets, business information, and website copy.
5.2 License to SwiftServe
You grant SwiftServe a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, modify, and distribute Your Content solely as necessary to provide, maintain, and improve the Services. This license includes the right to create backups, perform quality checks, and use Your Content for AI-assisted features you have enabled.
5.3 Responsibility for Content
You are responsible for ensuring you have all necessary rights to the content you upload, including images, logos, fonts, and text. You must not upload content that infringes the intellectual property rights of any third party.
5.4 Feedback
If you provide feedback, suggestions, or ideas about the Services, you grant SwiftServe a perpetual, irrevocable, royalty-free license to use that feedback without obligation to you.
6. AI Features and Generated Content
6.1 AI-Assisted Services
SwiftServe offers AI-powered features including SEO content generation, analytics insights, trend predictions, and chat assistance. These features use AI models provided by Google Vertex AI and Anthropic.
6.2 Accuracy and Review
AI-generated outputs may be inaccurate, incomplete, or unsuitable for your needs. You are responsible for reviewing, editing, and approving all AI-generated content before publishing or relying on it. SwiftServe does not guarantee the accuracy, quality, or fitness of AI outputs.
6.3 Data Used for AI
AI features use your business context information (business name, hours, menu, policies) to generate relevant outputs. End-customer personally identifiable information is not used as input for AI processing. AI usage is metered and subject to the limits of your subscription plan.
7. Acceptable Use
You agree not to, and will not allow others to:
- Use the Services for any unlawful purpose or in violation of any applicable law or regulation
- Upload content that is unlawful, infringing, defamatory, obscene, or harmful
- Attempt to gain unauthorized access to our systems, networks, or other user accounts
- Probe, scan, or test the vulnerability of the Services or circumvent security controls
- Interfere with or disrupt the Services or the servers and networks that host the Services
- Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Services, except to the extent permitted by applicable law
- Resell, sublicense, or provide the Services to third parties outside your organization without our written consent
- Use the Services to build a competing product or to benchmark the Services for competitive purposes
- Send spam, unsolicited communications, or use the Services for bulk messaging not related to legitimate restaurant operations
- Misrepresent your identity or affiliation with any person or entity
8. Third-Party Services
The Services integrate with third-party tools and platforms, including Stripe (payments), DoorDash (delivery), Uber Direct (delivery), and Auth0 (authentication). Your use of these third-party services is governed by their respective terms of service and privacy policies. SwiftServe is not responsible for the availability, accuracy, or practices of third-party services.
9. Service Availability
SwiftServe aims to provide high availability and reliability but does not guarantee 100% uptime. The Services depend on internet connectivity, third-party infrastructure (including cloud hosting and CDN providers), and integrations that are outside our direct control. Planned maintenance windows and unplanned incidents may occur. We will make reasonable efforts to notify you of planned maintenance in advance.
10. Intellectual Property
10.1 SwiftServe IP
SwiftServe and its licensors retain all rights, title, and interest in the Services, including all software, designs, templates, themes, UI components, documentation, and trademarks. Nothing in these Terms grants you any right to use SwiftServe''s trademarks, logos, or branding without our prior written consent.
10.2 License to Use
Subject to your compliance with these Terms and payment of applicable fees, SwiftServe grants you a non-exclusive, non-transferable, revocable license to access and use the Services during your subscription term for your internal restaurant business operations.
11. Confidentiality
Each party agrees to protect the confidential information of the other party using the same degree of care it uses for its own confidential information, but in no event less than reasonable care. Confidential information does not include information that is publicly available, independently developed, or lawfully obtained from a third party without restriction.
12. Privacy and Data Protection
Our collection and use of personal information is described in our Privacy Policy. By using the Services, you acknowledge and agree to our data practices as described therein.
Where you process personal data of your end customers through the Services, you act as the data controller and SwiftServe acts as your data processor. You are responsible for obtaining appropriate consent from your end customers and for complying with applicable data protection laws.
13. Warranties and Disclaimers
You warrant that you have the authority to enter into these Terms, that your use of the Services will comply with applicable laws, and that you have the necessary rights to all content you upload.
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWIFTSERVE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
SWIFTSERVE DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT DEFECTS WILL BE CORRECTED. SWIFTSERVE IS NOT RESPONSIBLE FOR THE QUALITY, SAFETY, OR LEGALITY OF FOOD OR SERVICES PROVIDED BY RESTAURANTS USING THE PLATFORM.
TRIAL PERIODS AND FREE FEATURES ARE PROVIDED WITHOUT ANY SERVICE LEVELS OR WARRANTIES.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
(A) NEITHER PARTY WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, GOODWILL, OR DATA, REGARDLESS OF THE CAUSE OF ACTION OR THE THEORY OF LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
(B) SWIFTSERVE''S TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICES WILL NOT EXCEED THE TOTAL AMOUNTS PAID BY YOU TO SWIFTSERVE IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
These limitations do not apply to: (i) your payment obligations under these Terms; (ii) your breach of Section 7 (Acceptable Use); (iii) either party''s infringement or misappropriation of the other party''s intellectual property rights; or (iv) liability arising from willful misconduct or fraud.
15. Indemnification
You agree to defend, indemnify, and hold harmless SwiftServe and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:
- Your Content or the content displayed on your restaurant website
- Your use of the Services in violation of these Terms
- Your violation of any applicable law or the rights of any third party
- Your restaurant''s food quality, safety, operations, or regulatory compliance
- Claims by your end customers related to orders, refunds, or services you provide
16. Term, Renewal, and Cancellation
16.1 Term
Your subscription begins on the date you sign up and continues for the billing period you selected (monthly or annual).
16.2 Renewal
Subscriptions renew automatically for successive periods of the same duration unless you cancel before the renewal date.
16.3 Cancellation
You may cancel your subscription at any time through the Client Portal or by contacting support@swiftserve.io. Cancellation takes effect at the end of the current billing period. No refunds are issued for partial billing periods unless required by law.
16.4 Data Export
Before your subscription ends, you may export your data using available tools or by contacting support. We will retain your data for 30 days after the effective cancellation date, after which it may be permanently deleted.
17. Suspension and Termination
We may suspend or terminate your access to the Services if:
- You materially breach these Terms and fail to cure within 15 days of notice
- You fail to pay fees when due
- Your use of the Services poses a security risk to us or other users
- We are required to do so by law or regulation
- Your account has been inactive for an extended period
We will make reasonable efforts to notify you of the reason for suspension when lawful to do so. Upon termination, your right to use the Services ceases immediately, subject to Section 16.4 regarding data export.
18. Publicity
We may identify you as a SwiftServe customer (by name and logo) in our marketing materials and website, unless you opt out by emailing contact@swiftserve.io.
19. Force Majeure
Neither party will be liable for delays or failures in performance caused by events beyond reasonable control, including natural disasters, internet or infrastructure outages, cyberattacks, strikes, acts of government, or pandemics. Each party will use commercially reasonable efforts to mitigate the impact of such events.
20. Governing Law and Dispute Resolution
20.1 Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of laws principles.
20.2 Arbitration
Except for claims seeking injunctive or equitable relief or claims regarding intellectual property rights, any dispute arising out of or relating to these Terms or the Services will be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Commercial Arbitration Rules. The arbitration will be conducted in the State of Texas. Judgment on the arbitration award may be entered in any court of competent jurisdiction.
20.3 Class Action Waiver
YOU AND SWIFTSERVE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.
20.4 Small Claims
Either party may bring an individual action in small claims court for disputes within that court''s jurisdictional limits.
21. General Provisions
21.1 Entire Agreement
These Terms, together with the Privacy Policy and any applicable order forms or addenda, constitute the entire agreement between you and SwiftServe regarding the Services.
21.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
21.3 No Waiver
Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
21.4 Assignment
You may not assign or transfer these Terms without our prior written consent. SwiftServe may assign these Terms to an affiliate or in connection with a merger, acquisition, or sale of all or substantially all of its assets.
21.5 Notices
We may provide notices via email to your account owner, through the Client Portal, or by posting to our website. Legal notices should be sent to contact@swiftserve.io.
22. Changes to These Terms
We may update these Terms from time to time. If we make material changes that adversely affect your rights, we will provide at least 30 days notice via email or through the Services. Your continued use of the Services after the effective date of any changes constitutes acceptance of the updated Terms.
